These Promotion Terms and Conditions (the “Terms”) govern participation in the “Tokenized stocks and ETFs” promotion (the “Promotion”) organized by BC Access (Nigeria) Limited (“Blockchain.com” or the “Sponsor”) in partnership with Ondo Finance, and made available to verified Blockchain.com users in Nigeria.
BY PARTICIPATING IN THIS PROMOTION, YOU AGREE TO BE BOUND BY THESE TERMS, THE BLOCKCHAIN.COM USER AGREEMENT, AND ALL APPLICABLE LAWS AND REGULATIONS, INCLUDING THE CONSUMER PROTECTION LAWS OF NIGERIA.
1. Eligibility. This Promotion is open to individuals who:
Are legal residents of Nigeria, physically located in Nigeria at the time of participation;
Are 18 years of age or older;
Have completed identity verification (KYC) through a verified Blockchain.com Trading Account; and
Use the Blockchain.com DeFi Wallet to complete eligible tokenized stocks purchases.
Excluded Persons: Employees, officers, directors, and agents of Blockchain.com, its affiliates, agencies, and immediate family members of those individuals are not eligible to participate.
2. Promotional Period. The Promotion begins at 12:00 AM WAT on 15/10 and ends at 11:59 PM WAT on 14/11, or when the Promotion’s total reward budget of 250,000 ONDO tokens is exhausted—whichever occurs first (the “Promotional Period”).
Blockchain.com’s internal systems will be the official timekeeper for this Promotion. Normal mobile data, Internet, or access charges may apply. Blockchain.com reserves the right to amend, supplement, or withdraw these Terms at any time. Updates will be published at https://support.blockchain.com/hc/enus/sections/17113468852764-Promotions and will take effect upon posting.
3. How to Participate. To participate, eligible users must:
Use the Blockchain.com DeFi Wallet within the mobile app;
Purchase any eligible tokenized stock listed by Ondo Global Markets;
Ensure that each purchase is at least USD $10 equivalent;
Complete the transaction using a wallet linked to a verified Blockchain.com Trading Account.
Blockchain.com will match wallet addresses to verified users using internal analytics systems. Rewards will only be distributed to eligible users successfully matched and verified.
Fraudulent or manipulative behaviour is strictly prohibited, including:
Multiple wallet use by the same individual
Wash trading or artificial volume creation
Use of bots or automated scripts
Attempting to bypass regional eligibility
Blockchain.com reserves the right to disqualify participants or revoke rewards at its sole discretion in the event of suspected fraud or abuse.
Blockchain.com reserves the right to modify, supplement, or remove any part of the conditions of participation and rewards outlined in sections 2, 3 and 4 of these Terms. Any such updates will be published at https://support.blockchain.com/hc/enus/sections/17113468852764-Promotions and will be effective upon posting.
When entering, you are required to provide complete and truthful information. Incomplete, illegible, corrupted, false, lost, late or misdirected, deceptive or otherwise non-compliant entries may be disqualified from the Promotion at Blockchain.com’s sole discretion. Entries submitted by persons who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. You are not permitted to use any scripts, computer programs, robotic repetitive, macro, automatic, programmed or similar automated entry methods or agents to submit entries. To participate in the Promotion, you agree to be bound by these Terms and to comply with any and all applicable federal, state and local laws, rules and regulations. Receiving the reward is contingent upon fulfilling all requirements set forth in these Terms. without giving effect to any choice of law or conflict of laws rules.
4. Reward Details. Participants may earn rewards in two ways:
A. Bonus Reward – Direct Incentive
Users earn 5 ONDO tokens for each of their first five different tokenized stocks and ETFs purchases, capped at 25 ONDO per user.
Each tokenized stock purchased must be unique and each transaction must be USD $10 equivalent or more.
Total rewards are distributed on a first-come, first-served basis, subject to a global campaign cap of 250,000 ONDO tokens.
Rewards will be credited to the user’s Blockchain.com Trading Account after successful verification and tracking.
B. Diversification Challenge – Limited Prize Pool
A separate pool of 10,000 ONDO tokens will be distributed to the first ten (10) verified users who purchase the least-traded tokenized stock(s) during the Promotional Period.
Each qualifying purchase must be ≥ $10 USD equivalent, and tokens must remain held at the end of the Promotion.
If fewer than 10 users qualify, the prize pool will be split proportionally among the eligible users.
Rewards will be distributed manually post-campaign upon identity verification.
5. Verification, Eligibility & Reward Conditions. Participation is subject to the following conditions:
Participants must comply with the Blockchain.com User Agreement and provide documentation to verify eligibility.
Rewards are non-transferable, non-exchangeable, and not redeemable for cash.
Blockchain.com may withhold, cancel, or reclaim rewards in cases of suspected abuse, fraud, or breach of these Terms.
This Promotion is not a sweepstakes, lottery, or game of chance. All rewards are deterministic based on defined conditions and available budget.
Participants are solely responsible for reporting and paying any applicable taxes under Nigerian tax laws.
6. Liability Release and Indemnity. THE REWARD IS OFFERED AND PROVIDED “AS IS” WITH NO WARRANTY OR GUARANTEE BY BLOCKCHAIN.COM, EITHER EXPRESS OR IMPLIED. IN NO EVENT WILL BLOCKCHAIN.COM NOR ANY OTHER RELEASED PARTIES BE LIABLE TO ANY ENTRANT OF THE PROMOTION FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH THEIR PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT BLOCKCHAIN.COM AND/OR OTHER RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
By participating in the Promotion, you agree to indemnify, defend and hold harmless Blockchain.com and each of the foregoing entities’ respective parent and affiliate companies, vendors, suppliers, agencies, consultants, subcontractors and legal counsel and each of their respective officers, directors, employees and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such individual (collectively, the “Released Parties”) from any and all liability for any claims, damages, injuries or losses of any kind, and to release all rights to bring any claim, action or proceeding arising out of, in connection with or relating to, (i) participation in Promotions, (ii) personal injury or property damage arising directly or indirectly from the acceptance, possession, misuse or use of the Reward, (iii) defamation or portrayal in a false light (intentional and unintentional), violation of publicity rights or invasion of privacy in connection with the Promotion or acceptance and use of the Reward, and (iv) any violation of third party intellectual property or other proprietary rights arising from or related to the Promotion or Blockchain.com’s advertising and marketing related to the Promotion, any entrants, in all cases. You assume all liability for any injury or damage caused, or claimed to be caused, by your participation in the Promotion, or the use of the Reward. You further agree that in any cause of action, Blockchain.com’s and/or the Released Parties’ liability will be limited to the value of the Reward, and in no event shall Blockchain.com be liable for attorney’s fees. The foregoing is only to the extent permitted by applicable law.
7. General Terms. Blockchain.com is not responsible if the Promotion cannot take place, or if the Reward cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government or other events outside of the reasonable control of Blockchain.com. If for any reason the Promotion is not capable of running as planned, Blockchain.com reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion in whole or in part. If the Promotion in whole or in part is terminated or modified prior to the closing of the Promotional Period, notice will be communicated by Blockchain.com. Blockchain.com reserves the right to modify and amend these Terms from time to time during the Promotional Period for clarification purposes. The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision. If any provision of these Terms is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Blockchain.com’s failure to enforce any provision of these Terms will not constitute a waiver of that term or any other provision of these Terms. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of these Terms or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials, Blockchain.com’s User Agreement or Privacy Notice and/or these Terms, these Terms shall prevail. All federal, state and local laws and regulations apply. These Terms and the Promotion in general shall be governed by and construed in accordance with Nigerian law, without giving effect to any choice of law or conflict of laws rules.
8. Privacy. All information submitted by you that is collected by Blockchain.com in connection with your participation in the Promotion will be subject to Blockchain.com’s User Agreement and its Privacy Policy. By participating in the Promotion, you hereby agree that Blockchain.com may collect and use your personal information submitted in connection therewith, and you acknowledge that you have read Blockchain.com’s Privacy Policy.
9. Binding Arbitration. Except where prohibited by law, you agree that (1) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE PROMOTION SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, (2) any dispute, controversy or claim arising out of or relating to the Promotion shall be resolved by binding arbitration administered by the Lagos Court of Arbitration (LCA) (3) any arbitration shall be heard by one (1) arbitrator to be selected in accordance with the LCA Rules, in Lagos, Nigeria, (4) unless both you and Blockchain.com agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of class or representative proceeding, (5) judgment upon any award rendered may be entered in any court having jurisdiction thereof and (6) any award or judgment shall be subject to all limitations and releases set forth in these Terms and be limited to actual out of pocket damages, and shall not, in any event, include any punitive, exemplary, consequential or incidental damages, attorney’s fees or costs of bringing a claim, or any injunctive or other equitable relief. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
Nothing in this clause shall prevent Nigerian residents from exercising any mandatory rights they may have under Nigerian law, including applicable consumer rights.
